What do Apple and Lugz have in common?

Did Apple copy a 2002 commercial from Lugz?  Lugz thinks so.  They are currently suing Apple and their Ad Agency: "If you look at these spots, common sense would tell you that there's a problem here. The Apple commercial uses the most powerful elements of our campaign, making the ads disturbingly similar. We are prepared to vigorously pursue all legal remedies in order to protect our rights."

If you ask me, it seems very doubtful that some of the best creative minds went out of their way to intentially rip off  an idea from an obscure shoe manufacturer that ran three years ago.
